Terms and Conditions for Inspection Services

By using the inspection services of PT.Lestari Citra Inspektindo, you are agree to be bound by the following terms and conditions. Please read this document carefully.


1. Definitions

• Inspection: The process of examining and evaluating an object, asset, or system in accordance with standards, regulations, or the Client's request.

• Inspection Report: A written document containing the findings, observations, and recommendations from the Inspection.

• Services: The inspection services provided by the Company to the Client.

• Client: The party requesting and receiving the Services from the Company.

• Service Fees: The amount of fees payable by the Client to the Company for the Services rendered.
  
  
  

2. Scope of Services

• The Company will provide Services in accordance with the Client's request and as stated in a separate proposal or agreement.

• The Scope of Inspection will be specifically determined for each assignment and may include, but is not limited to, visual inspections, non-destructive testing, measurements, and data analysis.

• The Company reserves the right to refuse a Service request if it is deemed beyond its competence or available resources.
  
  
  

3. Service Requests and Orders

• Service requests can be made verbally or in writing. However, written confirmation (e.g., via email or letter) is strongly recommended to avoid misunderstandings.

• Service orders are considered valid upon written agreement from both parties regarding the scope of work, schedule of execution, and Service Fees.
  
  
  

4. Fees and Payment

• Service Fees will be determined based on the Company's prevailing rates or as agreed upon in a separate proposal or agreement.

• Fees may include inspection costs, travel expenses, special equipment costs, and other relevant expenses.

• The Client is obliged to pay the Service Fees in accordance with the agreed payment schedule. Late payments may be subject to penalties in accordance with the Company's policy.

• All Service Fees are exclusive of applicable taxes and other charges as may be required by applicable laws and regulations.
  
  
  

5. Execution of Inspection

• The Client is responsible for providing safe and adequate access to the location and object to be inspected.

• The Client is obliged to provide accurate and complete information regarding the object to be inspected.

• The Company reserves the right to postpone or cancel the Inspection if site conditions are unsafe or if the information provided is inadequate.

• Inspections will be carried out by competent and experienced professionals.
  
  
  

6. Inspection Report

• The Company will provide the Inspection Report to the Client in the agreed format.

• The Inspection Report will contain findings, observations, and recommendations based on the Inspection performed.

• The Inspection Report is confidential and intended solely for the Client, unless required by applicable laws or regulations.

• The Company strives to present accurate and objective information in the Inspection Report. However, the interpretation and actions taken based on the Inspection Report are solely the responsibility of the Client.
  
  
  

7. Limitation of Liability

• The Inspection Services provided by the Company are based on visual conditions and tests conducted at the time of the Inspection. The Company is not responsible for hidden defects or damages not detected during the Inspection.

• Opinions and recommendations contained in the Inspection Report are professional and based on the Company's knowledge and experience at the time of the Inspection. The Company does not guarantee the outcome or consequences of implementing these recommendations.

• The Company's liability for losses or damages suffered by the Client as a result of the Services provided is limited to the amount of Service Fees paid by the Client.

• The Company is not liable for any indirect, incidental, or consequential damages arising from the use of the Services or the Inspection Report.
  
  
  

8. Confidentiality

• The Company and the Client agree to maintain the confidentiality of information obtained from each other during the execution of the Services, unless required by applicable laws or regulations.
  
  
  

9. Intellectual Property Rights

• All intellectual property rights related to the Inspection Report and other materials generated by the Company remain the property of the Company, unless otherwise agreed in writing.

• The Client has the right to use the Inspection Report for its internal purposes.
  
  
  

10. Cancellation and Termination

• The Client may cancel the Services with written notice to the Company in accordance with the agreed timeframe. Cancellation may be subject to fees in accordance with the Company's policy.

• The Company reserves the right to terminate the Services if the Client violates any of the provisions in these Terms and Conditions or if a force majeure event occurs that prevents the execution of the Services.
  
  
  

11. Governing Law and Dispute Resolution

• These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia.   

• Any dispute arising out of or in connection with these Terms and Conditions shall be resolved amicably through consultation.   
  
  
  
  

12. Miscellaneous

• These Terms and Conditions constitute the entire agreement between the Company and the Client regarding the Services and supersede all prior agreements or communications, whether oral or written.  

• The Company reserves the right to amend these Terms and Conditions from time to time with notice to the Client.

• If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

By proceeding with the request for Services from PT. Lestari Citra Inspektindo, you acknowledge that you have read, understood, and agreed to all of these Terms and Conditions.
